Hugo — iOS

These Terms of Use (the "Terms") are a contract between you and Dowhile, a company incorporated in Brazil under CNPJ 24.931.801/0001-39 ("Hugo," "we," "us"). They govern your use of the Hugo mobile app on iOS, our optional marketing website at https://usehugo.app, and any related services (together, the "Service"). By installing, opening, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Apple's standard EULA also applies (iOS)
On iOS, the Hugo app is also licensed to you under Apple's standard End User License Agreement (the "Apple EULA"), available at apple.com/legal/internet-services/itunes/dev/stdeula. If there is any conflict between these Terms and the Apple EULA, the Apple EULA governs the license to use the iOS app, and these Terms govern everything else (subscriptions, AI features, your content, support, and so on).
1. Who can use Hugo
You must meet the minimum age in your country to use the Service: 13 in the United States; 16 in the EU/EEA (or the lower age permitted by your member state, minimum 13); and the minimum age applicable in your country elsewhere. In Brazil, users under 18 must have the consent of a parent or legal guardian, consistent with Brazilian law. By using the Service you confirm you meet these requirements and have authority to enter into these Terms.
2. What Hugo is
Hugo is a recipe app for iPhone. You can save and organize recipes, import recipes from links you provide, adapt recipes and create your own versions, use collections, add private notes, and use optional AI features for recipe import and cooking Q&A. Free and paid tiers may differ as shown in the app. Features may change, be added, or be removed over time.
3. Your account
Some features require an account. You are responsible for keeping your login credentials secure and for activity that happens under your account. Provide accurate information and keep it up to date. One person, one account. You may close your account at any time; see the deletion process in our Privacy Policy.
4. Subscriptions
Hugo offers paid auto-renewing subscriptions that unlock additional features (for example, removing free-tier limits on imports and AI usage). The title, length, price, currency, and any free-trial terms of each subscription are shown to you in the app before you purchase, and are also displayed on the App Store product page.
- Billing — Payments are processed by Apple through your Apple ID. Hugo does not receive or store your payment card number for these purchases.
- Auto-renewal — Your subscription renews automatically at the end of each billing period at the then-current price for that subscription, unless you cancel at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
- Managing or canceling — You can manage and cancel your subscription at any time in your Apple ID Subscriptions settings on your device. Deleting the Hugo app does not, by itself, cancel your subscription.
- Free trials — If a free trial is offered, any unused portion of the trial period is forfeited when you purchase a subscription, where applicable.
- Price changes — We may change subscription prices for future billing periods. Where required by Apple or applicable law, we or Apple will notify you in advance and obtain any required consent before charging you the new price.
5. Refunds and cancellation
Because subscriptions are sold and processed by Apple, refund requests are generally handled by Apple under its refund policy. To request a refund, use reportaproblem.apple.com.
Brazilian consumers — right of regret (CDC Art. 49). If you are a consumer in Brazil and purchased a subscription remotely (outside a physical establishment), you may cancel within 7 days of purchase and receive a full refund, even if you have started using the subscription. To exercise this right, email us at chefhugoapp@gmail.com with the subject "Right of regret — refund request" within those 7 days. We will work with Apple to ensure the refund is processed. Nothing in these Terms limits the mandatory rights you have under the Brazilian Consumer Defense Code (Law No. 8,078/1990, "CDC") or other applicable consumer protection laws.
6. AI features
Hugo includes optional AI-powered features, including recipe import (extracting recipe data from links or media you provide) and conversational cooking help. When you use these features, your input and any recipe context you attach are sent to one or more third-party AI inference providers — currently OpenAI, Anthropic, and Google. See our Privacy Policy for details on this processing.
AI output may be inaccurate. AI features can produce results that are incomplete, incorrect, out of date, or unsafe — including incorrect ingredients, quantities, cooking times, temperatures, or substitutions, and missed allergens. Treat AI output as a suggestion, not a professional recommendation. Always verify ingredients, cooking times and temperatures, and food-safety information before relying on them.
Not medical, nutritional, or dietary advice. Hugo, including its AI features, does not provide medical, nutritional, dietary, or food-safety advice. Content in the Service is not a substitute for advice from a qualified professional. If you have allergies, dietary restrictions, a medical condition, are pregnant, are cooking for infants, or have any concern about food safety, consult a qualified professional. You are solely responsible for the food you choose to prepare and consume and for any decisions you make based on the Service.
The AI features are entirely optional. The rest of Hugo works without them.
7. Your content
You keep ownership of the recipes, notes, images, and other content you create, import, or upload to Hugo ("Your Content"). You grant us a worldwide, non-exclusive, royalty-free license to host, store, copy, reproduce, transmit, display, and process Your Content solely as needed to operate and provide the Service to you and the people you choose to share it with (for example, followers or recipients of a recipe you share). If you share content publicly within the Service or to another user, you also grant those users the rights necessary to view, save, and (where the feature is enabled) adapt that content or create their own version within Hugo.
We do not use Your Content to train AI models. We do not use Your Content (your recipes, notes, images, or chats) to train our own or third-party AI/foundation models. When AI features process Your Content to fulfill your request, we rely on our providers' standard API terms under which submitted content is not used to train their models. If we ever want to change this, we will update these Terms and our Privacy Policy, give notice, and obtain any consent required by law.
Your responsibilities for Your Content. You represent that you have the rights necessary to upload Your Content and to grant us the license above, and that Your Content does not violate these Terms or any applicable law (including intellectual property, privacy, and publicity rights). You are responsible for Your Content.
8. Acceptable use
When using the Service, you agree not to:
- break applicable law or infringe anyone's rights, including intellectual property, privacy, or publicity rights;
- upload, share, or generate content that is illegal, harmful, harassing, defamatory, hateful, sexually exploitative, or that promotes self-harm or violence;
- impersonate another person or misrepresent your affiliation with anyone;
- scrape, crawl, or use automated means to access the Service other than through features we expressly provide;
- attempt to reverse engineer, decompile, or otherwise derive the source code of the Service, except to the extent applicable law permits this despite this limit;
- interfere with, overload, or attempt to gain unauthorized access to the Service, other users' accounts, or our infrastructure;
- use the Service to develop a competing product, including by using AI outputs from Hugo to train another model; or
- misuse social features (for example, follow systems or recipe sharing) to harass, stalk, or spam other users.
We may remove content or suspend or terminate accounts that violate these rules, or where we reasonably believe doing so is necessary to protect users, the Service, or a third party.
9. Third-party services and links
Hugo relies on service providers (for example: Apple for app distribution and payments; Clerk for authentication; RevenueCat for subscription management; Supabase for data storage; Amazon Web Services for hosting in the European Union; OpenAI, Anthropic, and Google for AI inference; Sentry for error reporting; and PostHog for product analytics). Their services are subject to their own terms and policies. The Service may also contain links to or import content from third-party websites. We do not control those sites and are not responsible for their content, policies, or practices.
10. Privacy and international data processing
Our Privacy Policy explains what information we collect, why, and what choices you have. Hugo's primary data infrastructure is hosted in the European Union; some service providers (including our AI inference providers) operate in the United States. By using the Service you understand that Your Content and other information may be transferred to and processed in those locations, subject to the safeguards described in the Privacy Policy.
11. Intellectual property
The Hugo app, website, name, logo, designs, and software are owned by Dowhile and its licensors and are protected by copyright, trademark, and other laws. Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the Service for your personal, non-commercial use. All rights not expressly granted are reserved.
If you believe content in the Service infringes your intellectual property rights, contact us at chefhugoapp@gmail.com with enough detail for us to identify the content and your rights, and we will review your report.
12. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service if you breach these Terms or where we reasonably believe doing so is necessary to protect users, the Service, or a third party, or where required by law. If your subscription is active when this happens, the refund treatment described in Section 5 applies. Provisions that by their nature should survive termination (including content licenses you granted up to that point, disclaimers, limitations of liability, and governing law) will survive.
13. Disclaimers
To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that AI outputs will be accurate or suitable for your purposes.
Nothing in these Terms limits or excludes any right you have under the Brazilian Consumer Defense Code (CDC) or any other mandatory consumer protection law that applies to you. Where such law applies, the disclaimers in this section apply only to the maximum extent that law permits.
14. Limitation of liability
To the maximum extent permitted by applicable law, Dowhile and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or in connection with your use of the Service. To the maximum extent permitted by applicable law, our total aggregate liability to you for all claims relating to the Service in any 12-month period will not exceed the greater of (a) the amount you paid us for the Service in the 12 months before the event giving rise to the claim, or (b) USD 50 (or its equivalent in your local currency).
The exclusions and limits in this section do not apply to liability that cannot be excluded or limited under applicable law — for example, liability for death or personal injury caused by negligence, for fraud, or for rights guaranteed to consumers under the Brazilian Consumer Defense Code (CDC) or other mandatory consumer protection law.
15. Changes to the Service or these Terms
We may update the Service and these Terms from time to time. If we make material changes, we will change the "Last updated" date and provide additional notice in the app or by email where applicable law requires. Your continued use of the Service after the updated Terms take effect means you accept the changes. If you do not accept the changes, stop using the Service and (if applicable) cancel your subscription.
16. Governing law and disputes
These Terms are governed by the laws of the Federative Republic of Brazil, without regard to its conflict-of-laws principles.
For consumers. If you are a consumer, you may bring claims relating to these Terms in the courts of the place where you reside, as guaranteed by the Brazilian Consumer Defense Code (CDC) or, if you live outside Brazil, by the mandatory consumer protection law of your country. Nothing in these Terms deprives you of those protections.
For non-consumers. All other disputes arising out of or relating to these Terms or the Service will be brought exclusively in the courts of the State of São Paulo, Brazil, and each party submits to the jurisdiction of those courts.
The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.
17. Apple-specific terms (iOS)
If you use the Hugo iOS app, you acknowledge and agree that:
- these Terms are between you and Dowhile only, not with Apple, and Apple is not responsible for the app or its content;
- the license you have to use the iOS app is limited to a non-transferable license to use the app on any Apple-branded device that you own or control, as permitted by the App Store's Usage Rules;
- Apple has no obligation to provide maintenance or support for the app;
- if the app fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app;
- Dowhile, not Apple, is responsible for addressing any claims by you or a third party relating to the app, including product-liability and intellectual-property claims, subject to these Terms; and
- Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce these Terms against you as a third-party beneficiary.
18. Miscellaneous
These Terms, together with the Apple EULA (for iOS) and our Privacy Policy, are the entire agreement between you and us regarding the Service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our consent; we may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets.
